Contract of Sharecropping and its Rules

 Contract of sharecropping is one of the funding contracts which is authenticated and encouraged by the Islamic Sharia because it brings a lot of opulence, and causes permissible abundant endowment for individuals, society and the nation.  Sharecropping as a word is derived from cropping and sharing. It literally means that a man relies on another man for caring for his palm trees as the concerned man takes care of the palm trees in order to have an agreed and determined share from the crops and outcomes of such palms, trees, vines and the like. Sharecropping for Islamic jurisprudents has several definitions: one of those definitions is that a man relies on another to care, irrigate and to do all whatever required and needed for the concerned trees to finally have a section of their crops. Additionally, sharecropping could also be defined as relying on a specific a man, who is not the owner of trees to take care of another’s trees, palm trees, vines, etc. to finally have a share in their fruits for both of them. In this regard, it is noteworthy to mention that Islamic jurisprudents differ in determining legitimacy and eligibility of contract of sharecropping but it is commonly believed that most of them admit the legitimacy of such contracts because of their general benefit. Sharecropping has basics and specific conditions such as mutual agreement and admission, and it also depends on eligibility of contractors. This is because sharecropping is not available for underage and insane people. However, Islamic jurisprudents have different points of view concerning such basic rules and conditions which are fundamental and necessarily required in sharecropping contracts.
